There are several prerequisites to the admissibility of a breath test in a Kentucky DUI case. One of those prerequisites relates to the timing of the breath test relative to the end of operation of the vehice.
The law requires that any breath test result admitted to prove a per se offense be taken within two hours of the cessation of operation of the motor vehicle. One of the things the attorneys at Suhre & Associates, LLC will investigate is whether or not the police complied with this requirement. If not, then the breath test in your DUI case will have to be thrown out.
